Just make the switch,,thats it! Its that simple!! Make sure when u join the new company they file your perm asap and when u r in the 140 stage, you could work with your lawyer to port your old PD. AC21 has made life better!

A hypothetical, but important debate on worst case scenario in changing job using AC21

Assume changing jobs using AC21 has some risk, debate is what is that risk. I am not expecting response like pack up and leave back to home country as I already know that. I am interested serious debate from people who used AC21 and bought houses and simulated in American culture and have family reasons to stay in US.
Lets assume USCIS send some RFE and rejected 485 that new job was not same or similar. Now -
a) How many days I have to leave country ?
b) After the rejection of adjustment of status how many days I have to wrap up my current job or I must leave it same day when rejection letter received from USCIS ?
b) After those number of days can one acquire visitor's visa for up to six months to pack up stuff, house and family on the ground of rejection of adjustment of status?
c) Can one change status to some non immigrant visa such as new H-1B or F-1 by traveling back and reentering to USA ?
d) After the rejection of adjustment of status can one still port priority date in a new green card processing ?
f) I am also interested to hear feedback on what one can do to mitigate the risk of Ac21(I already know that use attorney's advise when changing job or donot change the job)

USCIS Expands I-140 Promium Processing to EB-1B (Outstanding Researcher) & EB-2 (Except NIW) Effective Next Monday, 09/25/2006
USCIS is scheduled to accept I-907 Premium Processing Request for Outstanding Researcher I-140 Petitions and Advanced Degree or Exceptionary Ability I-140 Petitions beginning from Monday, September 25, 2006. The categories of I-140 petitions which are excepted from the premium processing services are: EB-1A (Extraordinal Worker), EB-1C (Multinational Corporate Executive/Manager), EB-2(NIW).

tanyas_21: Amendment processing time is same as normal H1 processing time. Your status is H4 until the H1B amendment (797 w/ I-94) is approved or You re-enter USA after you get your H1B stamped. USCIS usually sends cable to home consulate mentioned in I-129 about the approval of H1B - It is one of the reason, most of the attorneys' recommend people to get it stamped from home consulate. As long as you go with all the paper work, You can get it stamped from Mexico, and I dont see any issues. Do not attempt to get it stamped from Canada unless you have a verifiable US education. so once your processing date is current, then no matter what (if your pd is current or not) they will start the Name Check process or will they wait until my PD is current to get started on the Name check process.

You can certainly file for EB-1 or EB-2 based on the job discription. You will need to file new LC/ I-140 in the respective category and once approved you can port your earlier PD.

Thanks for replying back. I dont think we would need a change in legislaturel for USCIS to start accepting i-485 applications, when the PD's are not current. I'm sure there must be a way we are just not thinking differently. If we were talking about getting the GC, then yes we would need a change in the legislative process via or bill and so the hopes from CIR. Currently EAD does not mandate a need to prove an employer-employee relationship during renewal or issuance as in the case of a H-1B application.

Looks like the long awaited spending bill is finally in the making and should make its way to the congress soon. For those of you who haven't contributed to IV, this should come as a warning that if you don't contribute now, it may just be too late for us to seek any relief in these bills.
Once this opportunity has passed, we'll be stuck with CIR which everyone knows is a tough pill to swallow for either party in the congress and could drag on for months and may never see the light of the day. So here are the choices:
1. Contribute now and try to get some relief from these spending bills.
2. Contribute later and try to get something done with CIR/SKIL.
3. Never contribute and just watch core members pull their hair trying to figure out why people are not contributing and just hope that GC will fall from sky.
Whatever you chose to do, please think twice before you make up your mind.

It will be subjective of the examining officer...he could choose to deny the 140, issue an RFE or may even just ignore it...
I understand is a grey area but i was wondering if anybody here had some issues like that. Hopefuly, whatever he does is not going to be denying it...

Yes, it is legal and possible to hold multiple H-1's with both non-profit and for profit employers.
